STOPSCAM – TERMS OF USE

1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of the StopScam mobile application, website, APIs, push-notification service, and any related content or technology (collectively, the “Services” or “Application”) provided by StopScam LLC, a Delaware limited-liability company (“Company,” “we,” “us,” or “our”). BY ACCESSING OR USING THE SERVICES YOU ACCEPT THESE TERMS AND OUR PRIVACY POLICY. If you do not agree, do not access or use the Services.
2. Eligibility
2.1 Age. You must be at least 18 years old—or the age of majority where you reside, if higher—and legally competent to enter a binding agreement.
2.2 Account Data. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your credentials and all activity under your account.
2.3 Authority. If you use the Services on behalf of an entity, you represent that you have authority to bind that entity; “you” includes that entity.
2.4 Children. The Services are not directed to children under 18, and we do not knowingly collect personal information from them.
3. License & Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Application on a compatible device solely for your personal, non-commercial purposes. All rights not expressly granted are reserved. You may not copy, modify, reverse-engineer, distribute, or sell the Services or circumvent security features.
4. Subscriptions, Trials & Auto-Renewal
One (1) full analysis is free. A three-day free trial automatically converts to a paid subscription unless cancelled at least 24 hours before trial end. Standard pricing is US $2.99 per month or US $29.99 per year. A time-limited discount (US $1.99 first month or US $14.99 first year) may be offered. Fees are processed by the applicable app store and renew at the then-current rate unless cancelled in your store settings. All purchases are final except where mandatory law or store policy provides otherwise.
5. Third-Party & Open-Source Components
The Services interoperate with third-party platforms and APIs— including OpenAI ChatGPT, Have I Been Pwned, Google Firebase, Apphud, Apple App Store Services, and Google Play Services—each governed by its own terms and privacy policy. We do not control or assume liability for third-party services.
6. Privacy & Communications
Our data practices are described in the StopScam Privacy Policy. By creating an account you consent to receive transactional, security, and marketing messages (email or push). You may disable pushes in your OS settings; doing so may impair critical functionality.
7. User Content & Conduct
You retain ownership of materials you upload (“User Content”) but grant us and our service providers a worldwide, royalty-free, non-exclusive license to process it for operating, improving, and providing the Services. You warrant that you have the necessary rights and that your content is lawful and non-infringing. You may not use the Services to violate law, harm others, or interfere with our networks. We may remove User Content or suspend accounts at our discretion.
8. Intellectual Property & Feedback
The Services—including text, graphics, code, models, and databases—are owned by StopScam LLC or its licensors and protected by U.S. and international laws. “StopScam,” related logos, and any Service names are trademarks of the Company. Any feedback you provide is non-confidential and becomes our sole property.
9. AI Functionality & Risk Scoring
The Application uses optical-character recognition (OCR) and large-language models to classify uploaded letters, emails, texts, screenshots, PDFs, images, and URLs, and then returns: (i) a probabilistic fraud-risk score, (ii) an explanation of key factors, and (iii) suggested next steps. Scores range from 1 % (unlikely scam) to 99 % (highly likely scam) and are generated entirely by AI.
10. AI Cybersecurity Assistant & Security Check
10.1 AI Assistant. An in-app AI cybersecurity assistant can answer general security questions. Responses are generated automatically and may be incorrect, incomplete, or outdated.
10.2 Security Check. The Application can: (a) query Have I Been Pwned® to detect email breaches; (b) list installed mobile apps and estimate device storage usage; (c) assess active Wi-Fi configuration; and (d) provide security recommendations. All findings are approximate, illustrative, and may miss threats or produce false positives.
11. Scam-Loss Estimates & Counters
To illustrate potential impact, we display an indicative dollar estimate per item: Model Probability × Published U.S. average loss for the detected fraud category (data sources include FTC Sentinel and FBI IC3). Estimates are rounded and capped at US $50,000 per item. Two counters are shown: a private Personal Counter (your cumulative estimates) and a public Global Counter (aggregate of all users). These numbers are illustrative marketing metrics—not audited financial data—and must not be relied upon for accounting, tax, or litigation purposes.
12. No Professional Advice
The Services—including risk scores, loss estimates, assistant answers, and Security Check results—are informational only and do not constitute legal, financial, cybersecurity, or professional advice. You remain solely responsible for any decisions you make.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION, OR THAT DEFECTS WILL BE CORRECTED.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOPSCAM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES—OR FOR ANY MONETARY OR OTHER LIABILITY OF ANY KIND—ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES; WHERE SUCH LAWS APPLY, THIS EXCLUSION APPLIES TO THE FULLEST EXTENT PERMITTED.
15. Indemnification
You agree to indemnify and hold harmless StopScam LLC and its affiliates from any claim, loss, liability, or expense arising out of (a) your violation of these Terms, (b) your misuse of the Services, (c) your User Content, or (d) your violation of law or third-party rights.
16. Dispute Resolution & Arbitration
Any dispute that cannot be resolved informally shall be settled by final, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Wilmington, Delaware, USA, and conducted on an individual basis (no class or representative actions). You may opt out of arbitration within 30 days of first using the Services by emailing legal@stopscam.ai; if you opt out, disputes shall be resolved in the state or federal courts of New Castle County, Delaware. This clause does not limit either party’s right to seek equitable relief for intellectual-property misuse.
17. Termination
You may cease using the Services at any time. We may suspend or terminate access immediately for breach of these Terms, legal or security risks, or discontinuation of the Services. Upon termination your license ends and Sections 8–23 survive.
18. Changes to Terms or Services
We may modify these Terms or the Services at any time. Material changes take effect 30 days after notice (e.g., in-app, push, or email). Continued use after the effective date constitutes acceptance. If you disagree, delete the Application and cease use before the effective date.
19. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet outages, and governmental actions.
20. Copyright Complaints (DMCA)
If you believe content infringes your copyright, send a DMCA notice to our Designated Agent at support@stopscam.ai with: (a) your physical or electronic signature; (b) identification of the copyrighted work and the alleged infringement; (c) your contact information; (d) a good-faith statement of infringement; and (e) a statement that the information is accurate under penalty of perjury.
21. Electronic Communications & Notices
You consent to receive communications electronically. We may provide legal notices via email, push, or posting within the Application or on our website. Notices to the Company must be sent to support@stopscam.ai and to:

22. Miscellaneous
Severability: If any provision is held invalid, the remainder remains in force.
Assignment: You may not assign these Terms without our consent; we may assign freely.
No Waiver: Failure to enforce any provision is not a waiver.
Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and the Company.
Headings: Headings are for convenience only.
23. Acknowledgment
BY CLICKING “ACCEPT”, INSTALLING, OR USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS OF USE—INCLUDING THE DISCLAIMERS OF WARRANTY, THE EXCLUSION OF LIABILITY, AND THE ARBITRATION AND CLASS-ACTION WAIVER IN SECTIONS 13–16. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
